Terms and Conditions
§1 General Provisions
The online store [“Store”] acts as an intermediary in retail sales via the Internet based on these terms and conditions [“Terms”].
Store owner: Todos Bien SC, based in Poland, Lipowa 16 B6, 81-572 Gdynia, NIP: 586-235-66-54.
The Terms are an integral part of the sales agreement concluded with the Customer.
A condition for concluding a sales agreement is the Customer’s acceptance of the Terms.
The Store operates on a dropshipping model.
The prices displayed in the Store are gross prices.
The goods available in the Store are free from physical and legal defects.
§2 Orders
Orders can be placed in the following ways:
- Using the form available on the Store’s website,
- By email to the address provided on the Store’s website.
To process an order, the Customer must provide data that allows for verification of the Customer and the recipient of the goods. The Store confirms order acceptance via email or phone. The Store has the right to refuse to accept an order, limit the payment method, or request an advance payment if the order raises justified doubts regarding the accuracy and reliability of the provided data or payment method.
The information provided on the Store’s website concerning a purchased product at the time of order placement is binding for both parties, particularly regarding the price, product description, product features, included components, as well as the delivery time and method.
The information on the Store’s website does not constitute an offer within the meaning of Polish civil law. By placing an order, the Customer submits an offer to purchase a specified product. The sales agreement is concluded upon the Customer’s confirmation of the Order by clicking on the confirmation link in the email sent by the Store.
§3 Payments
The Customer may use any of the payment methods available in the “payment methods” section on the Store’s website.
Shipping costs are specified in the delivery price list.
The condition for the release of the goods is payment for the product and delivery.
§4 Shipping of Goods
The goods are shipped directly to the Customer from the supplier with whom the Store cooperates on a dropshipping basis.
The supplier ships the ordered goods via courier companies.
For card payments, the order processing time starts from the day of positive transaction authorization by the bank.
For payments other than cash on delivery, the shipping time is extended by the period between placing the order and the date of crediting the due amount to the Store’s bank account.
§5 Complaints
A complaint is accepted based on the Customer presenting proof of purchase of the goods (receipt or invoice).
Complaints are handled by the goods supplier.
In case of non-compliance of the product with the agreement, the Customer should return the defective product to the supplier along with a description of the defect.
The supplier will respond to the Customer’s complaint in accordance with the supplier’s complaint handling policy. If verifying the defect requires an expert opinion or a statement from the manufacturer’s representative, the supplier’s decision-making time is extended by the time required to obtain such an opinion.
If the justified complaint requires sending a new product to the Customer or repairing defects, the Supplier covers the shipping costs.
The Customer’s individual computer and monitor settings causing incorrect or distorted product display (e.g., colors) cannot be a basis for a complaint.
§6 Right of Withdrawal from the Agreement
In accordance with the Act of March 2, 2000, on the protection of certain consumer rights and liability for damage caused by dangerous products, the Customer has the right to withdraw from the agreement.
The right to withdraw from the agreement is valid if the Customer submits a withdrawal statement to the Store within 10 days of receiving the goods.
The Customer must return the goods to the Store within 14 days from submitting the withdrawal statement. The returned goods must be undamaged, complete, in original packaging, and without any signs of use. The Customer covers the shipping costs.
Within 3 business days of receiving the returned goods, the Store will check their condition.
Within 7 days of checking the goods, the Store will refund the amount paid by the Customer, minus the order processing costs. The Customer must provide the bank account number to which the refund should be made.
If the Customer fails to comply with the conditions specified in paragraphs 2 and 3 above, the withdrawal statement is invalid, the goods cannot be returned, and the Store does not refund the paid amount.
The Customer has no right to withdraw from the agreement in cases specified in Article 10(3) of the Act mentioned in paragraph 1 above, namely in relation to:
- The provision of services that began with the Customer’s consent before the withdrawal deadline expired (this applies to services, not product sales),
- Audio and video recordings and software stored on computer data carriers if the Customer has removed their original packaging,
- Agreements related to remuneration whose price depends solely on financial market fluctuations,
- Goods with properties specified by the Customer in the order or closely related to the Customer’s personal preferences,
- Goods that cannot be returned due to their nature or are perishable,
- The supply of newspapers, periodicals, or gambling-related services.
§7 Privacy Protection
By placing an order, the Customer consents to the processing of their personal data solely for order fulfillment.
The Customer may also provide separate consent to receive promotional and marketing materials from the Store, including a commercial newsletter.
The Customer has the right to access, correct, and request the deletion of their data.
§8 Intellectual Property
The use of any materials published on the Store’s website (including product images and descriptions) without written consent from the Store and the Supplier is prohibited.
§9 Effective Date and Amendments to the Terms
The Terms come into effect on the date of their publication on the Store’s website.
The Store reserves the right to make changes to the Terms, which take effect on the date of their publication on the Store’s website. Agreements concluded before the changes to the Terms remain subject to the version of the Terms valid at the time of the Customer’s order placement.
